Availability of Certified Copies is Restricted to "Authorized Persons"

California Health and Safety Code, § 103526, enacted to prevent identity theft, limits access to certified copies of birth, death or marriage records to certain specified individuals. Those not authorized to receive a certified copy may obtain a copy marked "INFORMATIONAL, NOT A VALID DOCUMENT TO ESTABLISH IDENTITY."

Authorized persons are identified as follows:

Confidential Marriage Certificate — County Clerk Only

Birth, Death & Non-confidential Marriage Certificates

Those wishing to obtain a Certified Copy MUST complete the sworn statement included with the application form and sign the statement under penalty of perjury. The sworn statement included with any mailed request must be notarized. Mailed requests for a Certified Copy without the notarized sworn statement will be rejected as incomplete and returned unprocessed.

Note:

A member of a law enforcement agency or a representative of a state or local government agency, as provided by law, who orders a copy of a record in conducting official business shall not be required to provide the notarized statement.

An agent or employee of a funeral establishment who acts within the course and scope of his or her employment and who orders certified copies of a death certificate on behalf of any individual specified in paragraphs (1) to (5), inclusive, of subdivision (a) of § 7100, is not required to complete the notarized statement.
